A local court in Delhi heard a case related to the alleged Hate Crime during the communal riots in February 2020 in North-East Delhi. During this time, the court ordered an FIR against an officer of Delhi Police. The court has given this order against the police officer to fail to inquire about the alleged role of former MLA Kapil Mishra in the riot -related incident. The court condemned the behavior of the investigating officer (IO) and said that he tried to hide the allegations against the BJP leader.
FIR order on police officer
Judicial magistrate Udbhav Kumar Jain heard an application under Section 156 (3) of CRPPC, demanding a direction from the court to register an FIR against the then Jyoti Nagar SHO and others. The name of the police officer’s complaint is Mohammad Wasim. He claimed that he was among the five people who were allegedly attacked during communal riots on 24 February and forced to sing the national anthem.
A fast circulated video clip on social media featured five Muslim men allegedly beating by policemen and forcing them to sing the national anthem and national song “Vande Mataram”.
‘Police officers involved in crimes’
The court said in an order of January 18, “Clearly, SHO, Tomar and other unknown police officers of Jyoti Nagar Police Station were involved in disgusting crimes against the complainant or the victim. That is why they cannot be saved. The court said that under the guise of approval, the alleged crimes committed on their behalf cannot be said that they were performing their official duties. ”
The court directed that Section 295A against the then SHO (intentionally and malicious work, which aims to insult the religious sentiments of a class by insulting his religion or religious beliefs), 323 (voluntarily hurt), 342 (wrong manner Case of Section 506 (criminal intimidation) of the Indian Penal Code (IPC) should be registered.
‘Report does not mention concrete action’
The SHO of Jyoti Nagar was directed to appoint a responsible officer of less than the Inspector Rank to investigate the case. Along with this, during the investigation, instructions were also given to find the role of other unknown police officers involved in alleged crimes. The court said that an action report was filed by the IO in the case, in which the complainant’s allegations were denied. But the action report did not mention any concrete steps taken to conduct initial investigation and there was nothing regarding the footage of the CCTV camera of the alleged incident.
According to the court, the action report said, “In this way an investigation related to alleged acts or crimes against the complainant has not been properly conducted. The court has led the rioters to identify Kapil Mishra as the rioter led by Wasim. Claimed the claim also.
What did the complainant make allegations?
Complainant Wasim said that he saw that Delhi Police personnel were fully supporting the alleged accused Kapil Mishra. Policemen were also throwing stones at Muslims, firing bullets. Due to that attack, the protesters, women and children fled from there to save their lives and after that, most of the rioters led by Kapil Mishra went towards Chand Bagh.
In the case of allegations against Kapil Mishra, the court said that it seems that the IO was more concerned about the police officers. Either he failed to investigate against the alleged accused number 3 Kapil Mishra or tried to hide the allegations against the accused.
